Terms of Use

These Terms of Use ("Terms") govern your use of this website and any order you place with SYLK Co ("we", "us", "our"), whether online or through an in-person point-of-sale purchase in one of our locations. By using the site or placing an order, you agree to these Terms.

Who can use this site

You must be able to form a binding contract to place an order — generally, the age of majority in your province.

Products, pricing and availability

• All prices are shown in Canadian dollars (CAD) and don't include applicable taxes or shipping unless stated.
• We try to keep pricing, descriptions and stock levels accurate, but errors can happen. If we discover a pricing or listing error on your order, we'll contact you before charging or shipping anything, and you may cancel at no cost.
• Product photography for items without a real product photo uses representative placeholder imagery for that category rather than a photo of the exact unit; the written specifications on each product page are the authoritative description.
• We may change prices, descriptions or availability at any time without notice, and may limit order quantities.

Products sold on Amazon

Some products link to Amazon, where you complete the purchase instead of on this site. That purchase is made on Amazon, under Amazon's terms, payment, shipping and return policies; these Terms cover your use of this site, not the Amazon order.

Orders

Placing an order — online or at our point of sale — is an offer to buy. We may accept, decline or cancel any order (for example: pricing errors, suspected fraud, or a product going out of stock) and will let you know if that happens. An order confirmation email confirms we received your order, not that it has been accepted.

Payment

Payment is collected as cash or card at the time of delivery or at our point of sale — we don't collect or store your card details through this website. You're responsible for having a valid payment method available when your order is delivered or picked up.

Shipping, delivery and returns

Accounts

If you create an account, you're responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away if you believe your account has been accessed without authorization.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose, or in a way that could damage, disable or impair it.
• Attempt to gain unauthorized access to any part of the site, other users' accounts, or our systems.
• Scrape, harvest or systematically extract data from the site without our written permission.
• Submit false, misleading or fraudulent order or account information.

Intellectual property

The site's design, text, graphics, logos and product descriptions are owned by or licensed to SYLK Co and are protected by copyright and trademark law. You may not reproduce, distribute or create derivative works from this content without our written permission, other than printing a copy for your own personal or internal business use (for example, an order confirmation).

Third-party links

This site may link to third-party websites we don't control. We aren't responsible for the content, policies or practices of any third-party site.

Disclaimer of warranties

The site is provided on an as-is, as-available basis. To the extent permitted by law, we make no warranty that the site will be uninterrupted, error-free or completely secure. This does not affect any statutory warranty or manufacturer's warranty that applies to the products you purchase.

Limitation of liability

To the extent permitted by law, we aren't liable for indirect, incidental or consequential damages arising from your use of the site or a product purchased through it. Nothing in these Terms limits any liability that can't be excluded under applicable Canadian consumer protection law.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the site or breach of these Terms.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-law principles. Nothing here limits any right you have as a consumer under the mandatory laws of the province where you reside.

We may update these Terms from time to time; the date at the top of this page shows the last revision. Continuing to use the site after a change means you accept the updated Terms.
